These Terms of Use govern your use of the Gardenscape website at gardenscape.au and any related tools, forms or applications we make available (together, the Site). By using the Site you accept these terms. If you do not accept them, please do not use the Site.

Gardenscape is a landscaping and turf installation business operating in Melbourne, Victoria, Australia. In these terms, we, us and our mean Gardenscape, and you means the person using the Site.

Using the Site

You may use the Site to learn about our services, view our work and enquire about a project. You agree not to:

use the Site for any unlawful purpose, or in a way that damages or interferes with it
attempt to gain unauthorised access to the Site, its servers or any connected system
scrape, harvest or bulk-collect content or data from the Site by automated means without our written permission
copy, reproduce or republish our content except as permitted below or by law
submit false, misleading or fraudulent information through any form on the Site

Enquiries, quotes and pricing

Information on the Site is general in nature and is not an offer capable of acceptance. Any indicative pricing, timeframe or scope shown on the Site is an estimate only. A binding agreement is formed only when we provide a written quote for your specific site and you accept it in writing.

Submitting an enquiry does not create a contract or oblige us to provide services. We may decline any enquiry. Site conditions, access, ground conditions, council requirements and material availability can all change what a project costs, and a written quote will reflect those.

Mapping, location and other third party services

The Site may use third party services to provide features such as maps, location lookup, address autocomplete, service area display and route information. This includes Google Maps Platform services provided by Google.

By using any part of the Site that includes Google Maps features or content, you agree to be bound by the Google Maps and Google Earth Additional Terms of Service, available at https://www.google.com/help/terms_maps/, which incorporate the Google Terms of Service. You should read those terms before using those features.

Google collects and processes data when you use these features. That processing is governed by the Google Privacy Policy, which applies in addition to our own privacy policy. We do not control how Google collects or uses that data.

If you do not comply with the Google terms referred to above, we may suspend or withdraw your access to the mapping features on the Site.

Other third party services we may use include analytics, advertising measurement, email delivery and review platforms. Each is governed by its own terms and privacy policy. We are not responsible for the content, availability or practices of third party services or any site they link to.

Content, photographs and intellectual property

Unless stated otherwise, all content on the Site, including text, photographs of completed projects, designs, graphics and layout, is owned by us or used with permission, and is protected by copyright. You may view and print pages for your own personal, non-commercial use. Any other use, including reproduction on another website or in marketing material, requires our written permission.

Photographs show work we have completed. Individual results vary with site conditions, plant selection, aspect, soil and season, and are not a guarantee that your project will look identical.

Reviews and testimonials

Customer reviews shown on the Site are reproduced from third party platforms such as Google and are the opinions of the people who wrote them. We publish them as written. They reflect those customers’ experiences and are not a promise of any particular outcome for your project.

Availability of the Site

We aim to keep the Site available, but we do not guarantee it will be uninterrupted or error free. We may change, suspend or withdraw any part of the Site at any time without notice.

Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but may be limited, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.

Subject to the above, we are not liable for any indirect or consequential loss arising from your use of the Site, from reliance on general information published on it, or from any third party service accessed through it.

Information on the Site about soils, drainage, council requirements, overlays, tree protection or planning controls is general background and current only as at the date of writing. It is not advice for your property. Always confirm current requirements with your council or a qualified professional before relying on them.

Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
